Terms and Conditions

Welcome to Tasmanian Inquirer, or TI. These are the terms and conditions (“the terms”) that apply whenever you access TI by any means. By continuing to use or access TI you agree to be bound by the terms outlined below and any additional terms, conditions, notices and disclaimers on the site. Your use of and access to this site indicates your acceptance of and agreement with these terms as they exist at the time of use.

All or part of the terms may change at any time. Please check this page frequently to remain aware of any updates to the terms. If you do not agree with any of the terms please do not use the site.

Definitions

In these terms and conditions:
• Terms is defined as these terms and conditions along with the TI privacy policy and any additional terms, conditions, notices and disclaimers elsewhere on the site or in TI material;
• TI refers to all pages on this site, regardless of how they are accessed, and all accounts on third-party sites; and
• Material is defined as text, photos, audio, video, illustrations and any combination of these and other material.

Interaction with TI material

TI does not host readers’ comments on its site. It encourages rigorous debate on its official accounts established on third-party social media sites but expects community members to treat each other with respect and courtesy.

TI values the role of its readers and community in helping establish standards and etiquette for social media discussion. If you have concerns about inappropriate content, please contact TI on admin@tasmanianinquirer.com.au

TI has editorial control over the sites and its official accounts on third-party social media sites. It may edit, remove or exercise its discretion not to publish your contribution for legal, editorial or operational reasons. These include if TI considers your contribution to be:
• defamatory to TI;
• in violation of any laws regarding discrimination, racial vilification, privacy, harassment or contempt;
• an infringement of intellectual property rights including copyright;
• intended to harm, abuse, harass or stalk others;
• abusive, offensive, threatening, obscene or pornographic;
• repetitive, off-topic, deliberately provocative or vexatious;
• inappropriately personal about any person;
• impersonating another person;
• seeking to promote commercial products or services or to solicit donations; and
• containing viruses or other computer codes, files or programs designed to affect the functionality of other computer software or hardware.

TI reserves the right to block your account if you are found to be in breach of any of these terms.

As a user of TI, you acknowledge that TI is not responsible for, and accepts no liability in relation to, any other users’ use of, access to or conduct in connection with TI in any circumstance.

Use of TI content

TI retains all intellectual property rights to its site, third-party social media accounts and any content it publishes, including logos, images, names, designs, trademarks and copyright. The content is provided for readers’ personal, non-commercial use only unless otherwise agreed.

You may not remove, obscure or alter any TI logo or trademark on any content you use. You may not use TI content in a way that implies endorsement by TI or any person involved with publishing TI material.

You may not use any TI material to establish, maintain or provide your own publications or other means of distribution.

TI reserves the right to block your account should there be any improper use of TI materials. Any infringement of TI’s intellectual property including but not restricted to copyright infringement will result in legal action being taken.

Registration

You may be required to register to receive some TI content, such as email bulletins, and to donate or support TI. Registration is free. You are wholly responsible for all activities that occur under your details, including the unauthorised use of your credit card. Please notify TI immediately if you become aware of unauthorised use of your details on the site.

Any identifying or contact details will be used only in accordance with TI’s privacy policy. TI may refuse registration for any reason, including but not limited to the user impersonating another person or using an inappropriate login name. It is your responsibility to inform us of any changes to your registration information. You may terminate your account at any time by unsubscribing or contacting admin@tasmanianinquirer.com.au.

Disclaimers

TI does not endorse and is not responsible for the views or material contained in the contributions on its third-party sites and accounts. You use TI and its accounts at your own discretion and risk and you will be solely responsible for any damage or loss experienced as a result of your use of them. We are not responsible for, and accept no liability with respect to, any material uploaded, posted or transmitted on TI accounts. We do not endorse any opinion, statement or material posted by any person or organisation outside TI.

General

The terms will be governed by and construed in accordance with the laws of the state of Tasmania. If any provision or portion of these terms is found to be unenforceable by a court of competent jurisdiction the remainder will continue in full force and effect.

Privacy

Any and all personal details and data acquired by TI from your use of TI will be used in accordance with our privacy policy only.

Liability and Indemnity

TI provides all content to you on the condition that you undertake all responsibility for assessing the accuracy of the content and rely on it at your own risk. All content that you access through this site may be changed at TI’s sole discretion and without notice.

TI will have no responsibility or liability in relation to any loss or damage that you incur, including damage to your software or hardware, arising from your use of or access to this site.

Video

We may allow you to share or embed some video content on TI on third party sites. Such content may not be used for commercial purposes except with our prior written consent. No rights whatsoever in any content are granted to you through the sharing and embedding functions and TI reserves all rights in relation to the content.
